These Terms and Conditions form a binding agreement between Great Colorado Homes, Inc. and each person who uses greatcoloradohomes.com or any related services. If you do not agree, do not use the site.

5. MLS and IDX Data

Property data on listing pages is provided by the Pikes Peak Association of Realtors through an IDX feed. We do not guarantee accuracy or completeness of IDX data. Copyright for listing photos belongs to the original rights holders. If you believe material infringes your rights, see our DMCA page.

6. User Accounts and Contact

You may provide contact details to request info, schedule tours, or save searches. You agree to provide accurate information and to update it as needed. If you provide a phone number, you consent to receive calls or texts about real estate related services. Message and data rates may apply. You can opt out of texts by replying STOP.

7. Acceptable Use

• Do not violate laws or the rights of others.
• Do not upload malware or attempt to disrupt the Services.
• Do not scrape, harvest data, or attempt to bypass security.
• Do not post obscene, defamatory, or unlawful content.

8. Third Party Services and Links

The site may link to third party services, including lenders, inspectors, title companies, analytics, and advertisers. We are not responsible for their content or practices. Review their terms and privacy policies.

9. Privacy

14. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, even if we have been advised of the possibility. Our total liability for any claim related to the Services will not exceed the greater of one hundred US dollars or the amount you paid to us in the six months before the claim.

You agree to defend, indemnify, and hold harmless the Company and its affiliates from claims and costs, including reasonable attorney fees, arising from your use of the Services or your breach of these Terms.

16. Modification of the Terms

17. Term and Termination

We may suspend or terminate your access at any time with or without notice as allowed by law. Sections that by their nature should survive termination will survive.

18. Dispute Resolution and Arbitration

Before filing a claim, the parties will try in good faith to resolve the dispute within thirty days after written notice. If not resolved, any dispute or claim that relates to these Terms or the Services will be resolved by binding arbitration in El Paso County, Colorado before a single arbitrator. The Federal Arbitration Act and Colorado law apply. Either party may seek relief in small claims court for eligible matters. The arbitrator may not award punitive damages and may not certify a class.

Class action waiver. Each party may bring claims only in an individual capacity, not as a class member or representative.

19. Governing Law and Venue

Colorado law governs these Terms, without regard to conflict of law rules. For matters that are not subject to arbitration, the parties consent to the exclusive jurisdiction and venue of the state and federal courts in El Paso County, Colorado.

20. General Terms

• Severability. If any term is found invalid, the rest remain in effect.
• No waiver. A failure to enforce a term is not a waiver.
• Assignment. You may not assign your rights without our consent. We may assign as allowed by law.
• Entire agreement. These Terms and the documents they reference are the entire agreement for use of the Services.
• Electronic communications. We may send notices by email or by posting on the site.
